I’ve worked in 30 to 40 States in the Union now and there’s a thing called a “Best Interests Law”. In your State, you need to do the research to see what the best interest law is for you on how child custody cases are decided. I want to read a few that I’ve taken from different States to give you an idea of what you’re up against and what you need to prove in a child custody case.
- Physical and mental health
- Emotional stability
- Relationship with the child
- History of any domestic-violence
- Alcohol and drug-abuse
- Primary caretaker of the child
- If child has special needs
- Abuse and neglect
- Home environment
- The child’s preference
- Educational opportunities
- The court expert’s recommendation*
Which could-be the * custody evaluator. These are things to consider. When I work cases throughout the country the best interest laws are pretty similar everywhere I go. So, those are the things you need to know. I’m the Child Custody Guy and thank you for joining us today.
